Please read these Terms of Service ("Terms") carefully before using the Shervy AI mobile application ("Shervy", "the App", "we", "our"). By downloading, installing, or using Shervy, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Service Description

Shervy AI is a personal nutrition coaching app. It provides conversational nutrition guidance, meal logging via natural language chat and photo recognition, macro and calorie tracking, HealthKit integration, personalised coaching memory, and daily check-in nudges — all delivered through an AI-powered coaching interface.

Wellness service, not medical advice. Shervy AI is a wellness and nutrition coaching tool. It is not a medical device, medical provider, registered dietitian, or clinical nutritional service. Nothing in Shervy constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making significant changes to your diet or exercise regime, especially if you have a medical condition, eating disorder, or are pregnant or breastfeeding.

2. Eligibility

You must be at least 13 years old to use Shervy AI. By creating an account, you represent and warrant that you are 13 years of age or older. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly collect personal data from children under 13. If you are a parent and believe your child under 13 has created an account, contact us at shervyai.1@gmail.com for immediate account deletion.

3. Accounts and Authentication

You may sign in using Apple Sign In or Google Sign In. You are responsible for maintaining the security of your account. You must notify us immediately at shervyai.1@gmail.com if you suspect unauthorised access to your account.

You may delete your account at any time via Profile → Account → Delete Account. Deletion is permanent and immediately removes all your data from Shervy's systems.

4. Subscription and Billing

Shervy AI offers a subscription to access the full coaching experience:

Free Trial: New subscribers receive a 7-day free trial. You will not be charged during the trial period.
Subscription period: After the 7-day trial, the subscription automatically converts to a yearly (12-month) auto-renewing subscription.
Price: The current subscription price is displayed on the in-app paywall screen and in the App Store product listing. Prices are set in your local currency and may vary by region.
Auto-renewal: Your subscription will automatically renew for successive yearly periods at the then-current price unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.
Cancellation: You may cancel at any time through iOS Settings → Apple ID → Subscriptions → Shervy, or via the App Store. Cancellation takes effect at the end of the current subscription period; you retain access until then. Cancelling does not entitle you to a refund of amounts already charged.
Managing subscriptions: You can manage and cancel your subscription in your Apple ID account settings. Access via Settings → [your Apple ID] → Subscriptions on your iPhone.

Subscription management is handled through Apple's App Store. Shervy does not directly process payments. All billing disputes should be directed to Apple.

5. Acceptable Use

You agree not to:

Use Shervy for any unlawful purpose or in violation of any applicable laws.
Attempt to reverse engineer, decompile, or disassemble the App.
Use automated tools (bots, scrapers) to access or extract data from the App.
Attempt to gain unauthorised access to any part of the service or its infrastructure.
Upload or transmit malicious code or any content that could harm Shervy or other users.
Misuse the coaching AI to generate harmful content unrelated to nutrition and wellness.

6. AI-Generated Content

Shervy uses artificial intelligence (Google Gemini via Vercel AI Gateway) to generate personalised coaching responses, estimate food macros from photos, and extract coaching memories from your conversations. AI-generated content:

May not always be accurate. Macro estimates are approximations, not laboratory measurements.
Is not a substitute for advice from a registered dietitian or physician.
May occasionally produce unexpected or incorrect responses. Always apply your own judgment.

We improve the system continuously, but we cannot guarantee that AI responses will be free of errors at all times.

7. HealthKit Integration

With your permission, Shervy reads health data (steps, sleep, workouts, active energy, body mass) from Apple HealthKit to provide context-aware coaching, and writes nutritional data (dietary energy, protein, carbohydrates, fat, water) back to HealthKit after meal logging.

You may revoke HealthKit permissions at any time via iOS Settings → Health → Data Access & Devices. Revoking permissions will limit the coaching context available to Shervy but will not affect your account or other data.

8. Intellectual Property

The Shervy AI app, its design, code, branding, and content (excluding your personal data) are the intellectual property of Vincent Chew. You are granted a limited, non-exclusive, non-transferable licence to use the App for your personal, non-commercial purposes.

Your personal data (food logs, coaching memory, body metrics) belongs to you. We process it solely to provide the coaching service as described in our Privacy Policy.

9. Disclaimers and Limitation of Liability

It is not intended to diagnose, treat, cure, or prevent any health condition. The information provided should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always seek the guidance of a qualified health provider with any questions regarding a medical condition or eating disorder. If you are experiencing a medical emergency, call emergency services immediately.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHERVY AI IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED NUTRITION ESTIMATES WILL BE ACCURATE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VINCENT CHEW OR SHERVY AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY COACHING CONTENT.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
